Terms & Conditions
1. Scope of Services
Haus of Hounds LLC (hereinafter referred to as "Company") will provide the following services to the Client in connection with the estate or "haus" sale:
Pre-sale:
Assess the contents of the estate or "haus" and determine which items are saleable.
Organize and price the items for sale.
Advertise the estate or "haus" sale.
Sale Day:
Set up and manage the estate sale.
Sell items to customers.
Process payments.
Post-sale:
Clean up the estate and remove any unsold items.
Disburse the proceeds of the sale to Client.
2. Fees and Expenses
Client will pay Company a fee and percentage of the gross proceeds of the estate sale. Client will also be responsible for any expenses incurred in connection with the estate sale, such as advertising costs, transportation costs, and insurance costs.
3. Payment
Client will pay Company the standard fee in advance of the estate sale. The balance of the gross percentage will be due to Company on the day of the sale.
4. Insurance
Company maintains commercial liability insurance. Client is responsible for obtaining any additional insurance coverage that they deem necessary.
5. Condition of Items
All items are sold "as is, where is." Company does not warrant the condition of any items.
6. Liability
Company is not liable for any injuries or damages to persons or property that occur in connection with the estate sale. The company is not liable should possessions go missing during on-site or private haus sales. The company is not responsible for compensation of any item sold below estimated value.
7. Entire Agreement
These terms and conditions constitute the entire agreement between the parties and supersede all prior agreements, representations, and understandings between the parties, whether written or oral.
8. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the State of New York.
9. Severability
If any provision of this agreement is held to be invalid or unenforceable, such provision shall be struck from this agreement and the remaining provisions shall remain in full force and effect.
10. Waiver
No waiver of any provision of this agreement shall be effective unless in writing and signed by both parties.
